Terms of Use

1. Acceptance of Terms

By applying for membership, accessing the premises, or using any services provided by PYAANO ("the Club", "we", "us", "our"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you may not use our facilities or services.

These terms constitute a legally binding agreement between you ("Member") and PYAANO, governed by the laws of England and Wales.

2. Eligibility

2.1 Age: You must be 18 years of age or older to apply for membership or use PYAANO facilities and services. By submitting an application, you confirm that you are 18 or over.

2.2 Legal Capacity: You must have the legal capacity to enter into a binding contract under the laws of England and Wales.

2.3 One Account Per Person: Each individual may hold only one member account. Creating duplicate accounts is not permitted.

3. Membership Application & Approval

3.1 Application Process: Membership is by application only. PYAANO reserves the right to approve or decline any application at our sole discretion without providing a reason.

3.2 Accurate Information: You agree to provide accurate, complete, and truthful information in your application. See Section 10 for your ongoing data accuracy obligations.

3.3 Approval Notification: If approved, you will receive an email with membership setup instructions. Membership begins upon completion of setup and (where applicable) payment.

3.4 Incomplete Applications: If you start but do not complete your application, your partial data will be automatically deleted after 7 days. You will receive one reminder email before deletion.

3.5 Rejection: If your application is not approved, you will receive a notification. Rejected application data is handled in accordance with our Privacy Policy.

4. Membership Types & Fees

4.1 Membership Tiers: PYAANO offers various membership tiers with different access rights and pricing. Current options and fees are available on our website and may be updated from time to time.

4.2 Payment Terms: Membership fees are billed monthly or annually in advance. Payment must be made via approved payment methods. Non-payment may result in suspension or termination of membership.

4.3 Price Changes: PYAANO reserves the right to modify membership fees with 30 days' written notice. Continued use of services after notice constitutes acceptance of the new pricing.

4.4 No Refunds: Membership fees are non-refundable except as required by law. Credits or refunds are not provided for unused time or services unless otherwise stated.

5. Member Conduct & Rules

Members agree to:

• Treat all members, staff, and visitors with respect and courtesy
• Follow all posted rules and staff instructions at all times
• Respect noise levels and the comfort of other members
• Maintain cleanliness and return equipment and spaces to their original condition
• Report any accidents, injuries, or safety concerns to staff immediately
• Not engage in illegal activities, harassment, discrimination, or disruptive behaviour
• Not use the facilities while under the influence of drugs or excessive alcohol
• Not bring alcohol onto the premises without explicit permission from PYAANO staff
• Not bring outside food or beverages without permission
• Not solicit or conduct commercial activities directed at other members without PYAANO's prior written approval

5.1 Violation of Rules: PYAANO reserves the right to suspend or terminate membership immediately and without refund for violation of these rules. Serious or repeated violations may result in permanent bans from the premises.

6. Access & Entry (QR Codes)

6.1 QR Code Entry: Members are provided a unique QR code for facility access. This code is personal and non-transferable. You must not share, lend, or allow others to use your QR code. Misuse is a serious breach of these terms and may result in immediate membership termination.

6.2 Entry Logs: All entry and attempted entry activity is logged via QR scans for safety and security purposes. These logs record your name, membership number, profile photo URL, and exact timestamp. Logs are automatically deleted after 90 days in accordance with our Privacy Policy.

6.3 Waiver Requirement: You must have a current signed liability waiver on file before entry will be granted. Entry may be refused if your waiver is not current.

6.4 Guest Policy: Members may bring guests subject to availability and applicable guest fees. Guests must comply with all club rules. Members are responsible for the conduct of their guests.

6.5 ID Checks: Staff may request photo identification to verify your identity. Failure to present valid ID when requested may result in entry being refused.

6.6 Right of Refusal: PYAANO reserves the right to refuse entry to any individual at any time, including to active members, at our sole discretion — for example where conduct rules have been breached or where entry may compromise the safety of others.

7. Class & Event Bookings

7.1 Booking: Classes and events may be booked via the member portal. Bookings are subject to availability. Confirmation is provided upon successful payment (where applicable) or booking placement.

7.2 Payment: Paid bookings are processed via Stripe. By booking a paid class or event, you authorise PYAANO to charge the applicable fee to your selected payment method. Card details are handled directly by Stripe and are never seen or stored by PYAANO.

7.3 Booking QR Codes: Upon confirming a booking, you will receive a unique QR code for entry to that specific class or event. This QR code is personal and non-transferable. Do not share it with others.

7.4 Cancellation by Member: Cancellation policies (notice periods, refund eligibility, credit issuance) vary by class or event type and will be stated clearly at the time of booking. In general:

• Cancellations made with sufficient advance notice (as specified for each class/event) may receive a credit to use against future bookings
• Last-minute cancellations and no-shows are not eligible for credits or refunds unless otherwise stated
• Credits issued for cancellations are valid for the period shown and cannot be exchanged for cash

7.5 Cancellation by PYAANO: PYAANO reserves the right to cancel or reschedule classes and events at any time. Where a class or event is cancelled by PYAANO, affected members will be notified and will receive a credit or refund at PYAANO's discretion.

7.6 Attendance: Please arrive on time. Late arrivals may not be admitted once a class has begun.

7.7 Booking Records: Records of your bookings are retained for 24 months for accounting and legal compliance purposes, even after your membership ends.

8. Profile Photos & Photo Rights

8.1 Upload requirement: A profile photo is required to complete your membership application. By uploading a photo, you confirm that:

• You are the person depicted in the photo (or have the right to use it for this purpose)
• The photo is an accurate likeness that staff and members can use to identify you
• The photo does not infringe any third party's rights (copyright, privacy, etc.)

8.2 Licence to PYAANO: By uploading a profile photo, you grant PYAANO a non-exclusive, royalty-free licence to store, display, and use that photo for the following purposes only:

• Displaying your photo on your profile within the member portal and member directory (subject to your visibility settings)
• Displaying your photo on the QR scanner screen at the door to assist staff in verifying your identity upon entry
• Displaying your photo in PYAANO's administrative tools for member management purposes

This licence does not grant PYAANO the right to use your profile photo in external marketing, social media, or advertising without your separate consent.

8.3 Photo storage: Profile photos are stored on Cloudflare R2 (object storage). Your photo will be deleted from our systems when your account is deleted or your application is removed. See our Privacy Policy for full details.

8.4 Updating your photo: You may update your profile photo at any time via the member portal. PYAANO reserves the right to request a photo update if the current photo is no longer a sufficient likeness.

9. Member Directory

9.1 Opt-in: Participation in the member directory is optional. You control whether your profile is visible to other members via your profile settings at /portal/profile.

9.2 Directory visibility: When visible, your profile displays your name, photo, bio, disciplines, interests, and Instagram handle. Your phone number, email, birthday, and booking history are never shown in the directory.

9.3 Member follows: Members can follow one another within the platform. By following another member, your follow relationship is stored. You may remove follows at any time from your profile settings.

9.4 Respectful use: Directory information may only be used to connect with fellow PYAANO members within the spirit of the community. Commercial solicitation, data harvesting, or any use of directory information outside of legitimate member networking is strictly prohibited and may result in immediate membership termination.

10. Data Accuracy

10.1 Your responsibility: You are responsible for ensuring that the personal information you provide to PYAANO is accurate and kept up to date. This includes your name, email address, phone number, and profile photo.

10.2 Consequences of inaccuracy: Providing false or misleading information — including a profile photo that does not resemble you — is a breach of these terms and may result in membership suspension or termination.

10.3 Updating your data: Most profile fields can be updated directly in the member portal. For fields you cannot edit directly (such as date of birth after first entry), contact us at hello@pyaano.com.

10.4 Download your data: You can download a copy of your personal data at any time in CSV format from your account settings at /portal/account.

11. Account Termination & Cancellation

11.1 Member cancellation: You may cancel your membership at any time via the member portal (/portal/account) or by emailing hello@pyaano.com. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

11.2 Account deletion: You may request deletion of your account and all associated personal data. Deletion requests are subject to a 14-day grace period during which you may cancel the deletion. After 14 days, deletion is permanent. Some data may be retained for legal compliance reasons — see our Privacy Policy for details.

11.3 Termination by PYAANO: PYAANO reserves the right to suspend or terminate your membership at any time for:

• Breach of these Terms of Use
• Non-payment of membership fees
• Conduct that PYAANO reasonably considers harmful to members, staff, or the community
• Providing false or misleading information in your application or profile
• Misuse of QR codes or entry credentials

Termination for serious violations may be immediate and without refund. Termination for other reasons (e.g. persistent non-payment) will be preceded by reasonable notice where practicable.

11.4 Suspension: PYAANO may temporarily suspend membership access pending investigation of rule violations or payment issues.

12. Liability Waiver & Assumption of Risk

12.1 Waiver requirement: All members must sign a current liability waiver before using PYAANO facilities. By using PYAANO, you acknowledge the inherent risks of physical activities including dance, movement, fitness, creative workshops, and co-working.

12.2 Assumption of risk: You voluntarily assume all risks associated with use of PYAANO facilities, including but not limited to: injury from exercise or equipment use, slips, falls, or interaction with other members.

12.3 Release of liability: To the fullest extent permitted by law, you release and discharge PYAANO, its owners, employees, and agents from any and all claims, demands, or liabilities arising from your use of the facilities.

12.4 Medical conditions: You are responsible for consulting a healthcare professional before participating in physical activities. PYAANO is not responsible for pre-existing medical conditions or injuries resulting from failure to seek appropriate medical advice.

12.5 Waiver retention: Your signed waiver is retained for 7 years for insurance and legal compliance purposes, as described in our Privacy Policy.

13. Personal Property

PYAANO is not responsible for lost, stolen, or damaged personal property. Members are advised not to leave valuables unattended. Where lockers are available, they are provided for convenience and do not guarantee security.

14. Intellectual Property

14.1 Club content: All branding, designs, website content, class materials, and other materials created by PYAANO are the intellectual property of PYAANO and may not be reproduced, distributed, or used without our prior written permission.

14.2 Member work: Members retain full ownership of their creative work produced at PYAANO. By using our facilities, you do not grant PYAANO any rights to your creative work unless explicitly agreed in writing.

15. Venue Photography & Media

15.1 PYAANO-produced media: PYAANO may photograph or film events, classes, and activities at the venue for editorial, marketing, and promotional purposes. By attending events or using the facilities, you acknowledge that you may appear in such media.

15.2 Opt-out: If you do not wish to be photographed or filmed by PYAANO, please inform a staff member before or during the event. We will make reasonable efforts to accommodate your request.

15.3 Member photography: Members may take photos or videos for personal use within the venue, provided they do so respectfully and with the consent of other individuals who may appear in such media. Posting photos or videos of other members or staff to public social media without their consent is prohibited.

16. Modifications to Services

PYAANO reserves the right to modify, suspend, or discontinue any services, facilities, classes, or amenities at any time. We will provide reasonable advance notice of material changes where practicable. We are not liable for any losses arising from such modifications or temporary service interruptions.

17. Force Majeure

PYAANO is not liable for failure to perform obligations due to circumstances beyond our reasonable control, including but not limited to: natural disasters, government restrictions, pandemics, strikes, equipment failures, or utility outages. In such circumstances, we will make reasonable efforts to resume services as quickly as possible.

18. Limitation of Liability

To the fullest extent permitted by UK law, PYAANO's total liability to you for any claims arising from these terms or use of facilities shall not exceed the total membership fees paid by you in the 12 months preceding the claim. PYAANO is not liable for indirect, incidental, consequential, or punitive damages. Nothing in these terms excludes or limits liability that cannot be limited by law (including liability for death or personal injury caused by negligence, or for fraud).

19. Governing Law & Disputes

19.1 Governing Law: These terms are governed by the laws of England and Wales.

19.2 Dispute Resolution: We prefer to resolve disputes informally. If you have a complaint, please contact us at hello@pyaano.com in the first instance. We will aim to respond within 5 business days.

19.3 Jurisdiction: If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of England and Wales.

20. General Provisions

20.1 Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

20.2 Entire Agreement: These Terms of Use, together with our Privacy Policy and signed liability waiver, constitute the entire agreement between you and PYAANO regarding your membership and supersede all prior agreements.

20.3 No Waiver: PYAANO's failure to enforce any provision of these terms on any occasion shall not constitute a waiver of that provision.

21. Changes to Terms

PYAANO may update these Terms of Use at any time. Changes will be posted on this page with an updated "Last updated" date. Material changes will be communicated to active members by email with at least 14 days' notice. Continued use of services after the effective date of changes constitutes acceptance of the updated terms.

22. SMS Communications

22.1 Operational SMS: By providing a phone number during the membership application, you acknowledge that PYAANO may send you operational SMS messages using that number. These messages include class confirmations, schedule changes, booking reminders, and account notifications. Such messages are sent on the basis of PYAANO's legitimate interests in keeping members informed.

22.2 Marketing SMS: PYAANO will only send marketing or promotional SMS messages where you have separately opted in to receive them. You may withdraw your consent at any time.

22.3 Standard messaging rates: Standard messaging and data rates charged by your mobile carrier may apply to SMS messages you receive from PYAANO. PYAANO is not responsible for any charges incurred.

22.4 Opt-out: You may opt out of SMS communications at any time by replying STOP to any SMS from PYAANO, or by contacting us at hello@pyaano.com. Opting out of marketing SMS does not affect transactional messages related to active bookings. For full details on how your phone number is processed, see our Privacy Policy.
