1. Acceptance of Terms

By applying for membership, accessing the premises, or using any services provided by PYAANO ("the Club"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use our facilities or services.

These terms constitute a legally binding agreement between you ("Member") and PYAANO.

2. Membership Application & Approval

2.1 Application Process: Membership is by application only. PYAANO reserves the right to approve or decline any application at our sole discretion without providing a reason.

2.2 Accurate Information: You agree to provide accurate, complete, and truthful information in your application and to update it as necessary.

2.3 Approval Notification: If approved, you will receive an email with membership setup instructions. Membership begins upon completion of setup and payment.

3. Membership Types & Fees

3.1 Membership Tiers: PYAANO offers various membership tiers with different access rights and pricing. Current membership options and fees are available on our website and may be updated from time to time.

3.2 Payment Terms: Membership fees are billed monthly or annually in advance. Payment must be made via approved payment methods. Non-payment may result in suspension or termination of membership.

3.3 Price Changes: PYAANO reserves the right to modify membership fees with 30 days' written notice. Continued use of services after notice constitutes acceptance of new pricing.

3.4 No Refunds: Membership fees are non-refundable except as required by law. Credits or refunds are not provided for unused time or services.

4. Member Conduct & Rules

Members agree to:

• Treat all members, staff, and visitors with respect and courtesy
• Follow all posted rules and staff instructions
• Respect noise levels and the comfort of other members
• Maintain cleanliness and return equipment/spaces to their original condition
• Report any accidents, injuries, or safety concerns immediately
• Not engage in illegal activities, harassment, discrimination, or disruptive behaviour
• Not bring outside food or beverages without permission
• Not use facilities while under the influence of drugs or excessive alcohol

4.1 Violation of Rules: PYAANO reserves the right to suspend or terminate membership immediately for violation of these rules without refund.

5. Access & Entry

5.1 QR Code Entry: Members are provided a unique QR code for facility access. This code is personal and non-transferable. Do not share your QR code with non-members.

5.2 Entry Logs: All entry/exit activity is logged via QR scans for safety and security purposes. These logs are retained for 90 days.

5.3 Guest Policy: Members may bring guests subject to availability and guest fees. Guests must follow all club rules, and members are responsible for guest conduct.

5.4 Operating Hours: Facility access is limited to posted operating hours. Hours may vary by membership tier or during holidays.

6. Liability Waiver & Assumption of Risk

6.1 Waiver Requirement: All members must sign a liability waiver before using facilities. By using PYAANO, you acknowledge the inherent risks of physical activities including dance, movement, fitness, and co-working.

6.2 Assumption of Risk: You voluntarily assume all risks associated with use of PYAANO facilities, including but not limited to: injury from exercise, equipment use, slips/falls, or interaction with other members.

6.3 Release of Liability: To the fullest extent permitted by law, you release and discharge PYAANO, its owners, employees, and agents from any and all claims, demands, or liabilities arising from your use of the facilities.

6.4 Medical Conditions: Members are responsible for consulting healthcare professionals before participating in physical activities. PYAANO is not responsible for pre-existing medical conditions or injuries resulting from failure to disclose medical information.

7. Personal Property

PYAANO is not responsible for lost, stolen, or damaged personal property. Members are advised not to leave valuables unattended. Lockers (if available) are provided for convenience but do not guarantee security.

8. Intellectual Property

8.1 Club Content: All branding, designs, website content, and materials created by PYAANO are the intellectual property of PYAANO and may not be reproduced without permission.

8.2 Member Content: Members retain ownership of their creative work produced at PYAANO. By using our facilities, you do not grant PYAANO any rights to your work unless explicitly agreed in writing.

9. Photography & Media

PYAANO may take photos or videos of the premises, events, and members for marketing and promotional purposes. By using our facilities, you consent to being photographed or filmed and to the use of such media in PYAANO marketing materials. If you do not wish to be photographed, please notify staff.

10. Termination & Cancellation

10.1 Member Cancellation: Members may cancel membership at any time by providing 30 days' written notice. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

10.2 Club Termination: PYAANO reserves the right to terminate membership at any time for breach of these terms, non-payment, or misconduct. Termination may be immediate without refund in cases of serious violations.

10.3 Suspension: PYAANO may temporarily suspend membership pending investigation of rule violations or payment issues.

11. Modifications to Services

PYAANO reserves the right to modify, suspend, or discontinue any services, facilities, classes, or amenities at any time without notice. We are not liable for any such modifications or service interruptions.

12. Force Majeure

PYAANO is not liable for failure to perform obligations due to circumstances beyond our reasonable control, including but not limited to: natural disasters, government restrictions, pandemics, strikes, equipment failures, or utility outages.

13. Limitation of Liability

To the fullest extent permitted by UK law, PYAANO's total liability to you for any claims arising from these terms or use of facilities shall not exceed the total membership fees paid by you in the 12 months preceding the claim. PYAANO is not liable for indirect, incidental, consequential, or punitive damages.

14. Governing Law & Disputes

14.1 Governing Law: These terms are governed by the laws of England and Wales.

14.2 Dispute Resolution: Any disputes shall be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms of Use, together with our Privacy Policy and liability waiver, constitute the entire agreement between you and PYAANO regarding your membership and supersede all prior agreements or understandings.

17. Changes to Terms

PYAANO may update these Terms of Use at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of services after changes constitutes acceptance of the updated terms. Material changes will be communicated via email.
